Marijuana in the State of Missouri

In the state of Missouri, medical marijuana is legal as of November 6, 2018 when the medical marijuana program was approved through a ballot measure. To be able to obtain a medical marijuana card a citizen must be 18 years or older and a legal resident of Missouri. They must be evaluated in-person by a state-licensed physician and dagnosed with a qualifying condition and obtain a physician certification. Once the citizen receives the certification, they can apply for a medical marijuana identification card from the Missouri Department of Health & Senior Services. These qualifying conditions are Cancer, Epilepsy, Glaucoma, HIV/AIDS, PTSD, any terminal illness, Intractable migraines unresponsive to other treatment, A chronic medical condition that causes severe, persistent pain or persistent muscle spasms, including but not limited to those associated with multiple sclerosis, seizures, Parkinson’s disease and Tourette’s syndrome. Any other chronic, debilitating or other medical condition, including, but not limited to, hepatitis C, amyotrophic lateral sclerosis, inflammatory bowel disease, Crohn’s disease, Huntington’s disease, autism, neuropathies, sickle cell anemia, agitation of Alzheimer’s disease, cachexia and wasting syndrome.

In the state of Missouri, recreational marijuana is illegal; however, the state has decriminalized the possesion of small amounts of marijuana. In 2017, a new law went into effect that makes possession of fewer than 35 grams of pot punishable by a fine of between $250 and $1,000. While that’s still substantial, the penalty does not include any jail time. However, if anyone is caught with more than 35 grams (an amount equivalent to just about 1.25 ounces), that’s considered a felony offense that is punishable by as many as seven years in jail and a fine of as much as $5,000. After medical marijuana was approved, a state lawmaker prefiled a bill for the upcoming session that, if enacted, would permit adults 21 and older to legally grow, possess and consume marijuana. Individuals would be allowed to keep up to two ounces of cannabis and grow up to six plants—three of which could be “mature, flowering plants” at a time.

Major applications of drug testing include detection of the presence of performance enhancing steroids in sport, employers and parole/probation officers screening for drugs prohibited by law (such as cannabis, cocaine, methamphetamine, and heroin) and police officers testing for the presence and concentration of alcohol (ethanol) in the blood commonly referred to as BAC (blood alcohol content). BAC tests are typically administered via a breathalyzer while urinalysis is used for the vast majority of drug testing in sports and the workplace. Numerous other methods with varying degrees of accuracy, sensitivity (detection threshold/cutoff), and detection periods exist. A drug test may also refer to a test that provides quantitative chemical analysis of an illegal drug, typically intended to help with responsible drug use.
