According to the National Institute on Drug Abuse, in 2017, there were 144 overdose deaths involving opioids in Kansas—a rate of 5.1 deaths per 100,000 persons which is about 1/3 the national rate of 14.6 deaths per 100,000 persons. The greatest change in the number of opioid-involved deaths occurred among cases related to prescription opioids. Deaths decreased from 122 in 2014 to 89 in 2017. Drug overdose deaths involving heroin or synthetic opioids (mainly fentanyl) did not change overall during the same three-year period.
Research also revealed that in 2017, Kansas providers wrote 69.8 opioid prescriptions for every 100 persons compared to the average U.S. rate of 58.7 prescriptions for every 100 persons (CDC). This represents a 20% decrease from the 88 opioid prescriptions per 100 persons in 2011.The rate of opioid involved overdose deaths has not changed overall since 2004
According to cjonline.com, “Kansas has received about $30 million in federal grant funding, which has supported prevention, awareness, education and treatment to combat the opioid crisis. But funding, which comes in “somewhat haphazardly,” has been a source of frustration for treatment providers, Lakin said.
The Governor’s Task Force made 34 recommendations in five focus areas: provider education, prevention, treatment and recovery, law enforcement, and Neonatal Abstinence Syndrome. Recommendations include establishing permanent funding sources for various programs, increasing awareness and use of the state’s prescription drug monitoring program, expanding medication-assisted treatment and promoting the use of naloxone, an overdose antidote.
Lakin signed a standing prescription allowing anyone in the state to go into a pharmacy and get naloxone. Now he is working to spread awareness about the potentially lifesaving drug, which is marketed as Narcan, hoping to get it in the hands of more police and emergency medical service workers, along with friends and family members of those with the potential to be at risk of overdose.”

In the State of Kansas, recreational and medical marijuana are prohibited and illegal. Kansas seems to be one of the stricter States who treat marijuana possession as just a slightly lighter substance than coke, heroin and other drugs. The first possession charge is a misdemeanor that can be penalized up to one year in jail and a $2,500 fine, the second marijuana possession charge is a Severity Level 5 drug felony where your sentence will depend on your prior criminal history.
Kansas law bases the felony severity level for selling marijuana on the amount of marijuana involved:
- Less than 25 grams is a level 4 felony
- 25 to 450 grams is a level 3 felony
- 450 grams to 30 kilograms is a level 2 felony
- 30 kilos or more is a level 1 felony
The penalty ranges from the 10 months for a level 4 felony to 17 years for a level 1, plus a fine up to $500,000 for a level 1 or 2 offense.
If you had at least 450 grams of marijuana in your possession, you’ll be presumed to have been selling, unless you can show otherwise.
The level will be bumped up a level if the weed was sold or distributed on or within 1,000 feet of any school property.
